TERMS OF USE OF THE LAW SOCIETY OF HONG KONG’S APP

 

These Terms of Use (“Terms”) govern your use of the application (the “App”) published by The Law Society of Hong Kong (the “Law Society” or “we” or “us”), and unless other terms and conditions expressly govern, any other electronic services from the App that may be made available from time to time without prior notice although normally we aim to provide seven days prior notice (each, a “Service”).

By downloading or otherwise accessing the App you agree to be bound by the following terms and conditions. If you have any queries about the App or these Terms, you can contact us by any of the means set out in section 9 of these Terms. If you do not agree with these Terms, you should cease using the App and delete it immediately.

1. Changes to Terms of Use

The Law Society reserves the right to update these Terms from time to time without prior notice. If it does so, the updated version will be effective immediately, and the current Terms are available through a link in the App to this page.  You are responsible for regularly reviewing these Terms so that you are aware of any changes to them and you will be bound by the new policy upon your continued use of the App.  No other variation to these Terms shall be effective unless in writing and approved by an authorised representative on behalf of the Law Society.

2. Privacy and Your Account

You acknowledge and agree that the Law Society may through the App have authority to access, modify and/or delete the storage and content on your device and have full internet access via your device for the purposes of serving you. The Law Society together with its service providers may also collect, store, use and share user's data and related information, including but not limited to technical information about your device, system, location and application software, and peripherals that are gathered periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the App. Cookies may also be installed to improve the App.  The Law Society may use these information to update our membership database and improve our operations, services or technologies to you and other members of the Law Society, and you hereby consent to receiving push messages and other forms of marketing from us, our affiliates and partners.  If your access to a Service has been provided by or through a third party (each, a “Third Party”), the Third Party may have provided us with information about you to enable us to provide you with access to the Service and distinguish you from other members (such as your email address or name). If you access a Service using a password, you are solely responsible for maintaining the confidentiality of that password. If you provide someone else with access to your password to a Service, they will have the ability to view information about your account and make changes through the website for the Service. Similarly, if you tell someone the answer to your security question for a Service, they will be able to request information about your account and make changes through Customer Service. You agree to notify us promptly if you change your address or email so we can continue to contact you and send any notices required hereunder. If you fail to notify us promptly of a change, then any notice we send to your old address or email shall be deemed sufficient and effective notice.

3. Personal Information Collection Statement

The personal data collected (“the data”) by the Law Society of Hong Kong (“the Society”) from a subscriber of the Law Society App (“the App”) is used for verifying the identity of the subscriber for the purpose of providing the services of the App to the subscriber and related matters.  Information on the hits of the contents of the App is tracked for statistical and research purposes without identifying any individual and in the process, no personal data is collected.

In subscribing to the App, it is obligatory for you to supply the Society with the data requested in this form except as otherwise indicated. The consequence for you if you fail to supply such data is that the Society will not be able to provide the services of the App to you. 

The data may be provided to such persons within the Society whose proper business it is to have access to and assist in the provision of the services of the App.  The data may also be provided to the App developer, and such other persons who may help the Society in attaining the purposes above mentioned.

You have the right to request access to and correction of the data. Any such request should be addressed to the Secretary General, the Law Society of Hong Kong, 3/F, Wing On House, 71 Des Voeux Road Central, Hong Kong.

4. General rules relating to conduct

4.1  The App is made available for your own personal use. Only one individual may access a Service at the same time using the same user name or password, unless We agree otherwise. The App must not be used for any illegal or unauthorised purpose. When you use the App you must comply with all applicable laws of Hong Kong and with any applicable international laws, including the local laws in your country of residence and the local laws of where you are obtaining access to the Service (together referred to as “Applicable Laws”).

4.2  You agree that when using the App you will comply with all Applicable Laws and these Terms. In particular, but without limitation, you agree not to:

(a) use the App in any unlawful manner or in a manner which promotes or encourages illegal activity, including without limitation, defamation, copyright infringement or infringement of any other types of intellectual property; or
(b) attempt to gain unauthorised access to the App or any networks, servers or computer systems connected to the App; or
(c) modify, adapt, translate or reverse engineer any part of the App or re-format or frame any portion of the pages comprising the App, save to the extent expressly permitted by these Terms or Applicable Laws.

4.3  You agree to indemnify the Law Society in full and on demand from and against any loss, damage, costs or expenses which they suffer or incur directly or indirectly as a result of your use of the App otherwise than in accordance with these Terms or Applicable Laws.

5.  Content

5.1  The copyright in all material contained on, in, or available through the App including all information, data, text, music, sound, photographs, graphics and video messages, the selection and arrangement thereof, and all source code, software compilations and other material (“Material”) is owned by or licensed to the Law Society. All rights are reserved. You can view, print or download extracts of the Material for your own personal use but you cannot otherwise copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit, disseminate in any form whatsoever or use the Material without the Law Society’s express permission.

5.2 The trademarks, service marks, and logos (“Trade Marks”) contained on or in the App are owned by the Law Society or third party partners of the Law Society. You cannot use, copy, edit, vary, reproduce, publish, display, distribute, store, transmit, commercially exploit or disseminate the Trade Marks without the prior written consent of the Law Society or the relevant group company or the relevant third party partner of the Law Society.

6.  Link to third parties

The App may contain links to websites operated by third parties (“Third Party Websites”).  Notwithstanding such affiliate programmes, the Law Society does not have any influence or control over any such Third Party Websites and, unless otherwise stated, is not responsible for and does not endorse any Third Party Websites or their availability or contents.

7.  Disclaimer

7.1 Use of the App is at your own risk. The App is provided on an “as is” basis to the maximum extent permitted by law: (a) the Law Society disclaims all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to the App; and (b) all implied warranties, terms and conditions relating to the App (whether implied by statue, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose, availability, non-infringement, information accuracy, interoperability, quiet enjoyment and title are, as between the law society and you, hereby excluded. In particular, but without prejudice to the foregoing, we accept no responsibility for any technical failure of the internet and/or the App; or any damage or injury to users or their equipment as a result of or relating to their use of the App. Your statutory rights are not affected.

7.2  The Law Society will not be liable, in contract, tort (including, without limitation, negligence), under statute or otherwise, as a result of or in connection with the App, for any: (i) economic loss (including, without limitation, loss of revenues, profits, contracts, business or anticipated savings); or (ii) loss of goodwill or reputation; or (iii) special or indirect or consequential loss.

7.3 If the Law Society is liable to you directly or indirectly in relation to the App, that liability (howsoever arising) shall be capped at one Hong Kong dollar.

7.4  Nothing in these Terms shall be construed as excluding or limiting the liability of the Law Society or its group companies for death or personal injury caused by its negligence or for any other liability which cannot be excluded by Hong Kong law.

8.  Service Suspension

The Law Society reserves the right to suspend or cease providing any services relating to the Apps published by it, with or without notice, and shall have no liability or responsibility to you in any manner whatsoever if it chooses to do so.

9. Governing Law and Jurisdiction

All disputes, claims or controversies arising out of these Terms, or the negotiation, validity or performance of these Terms, or the transactions contemplated hereby will be governed by and construed in accordance with applicable Laws without regard to its rules of conflict of laws.  Each of the parties hereby irrevocably and unconditionally consents to submit to the sole and exclusive jurisdiction of the Hong Kong courts for any litigation among the parties hereto arising out of or relating to this Agreement, or the negotiation, validity or performance of this Agreement.
